Stark & Stark Shareholder Rachel Lilienthal Stark, member of the firm’s Business & Corporate group, authored the article “How to Avoid Legal Pitfalls When Using Freelancers and Other Consultants,” published in Moxie Woman Magazine in June 2013. The article discusses what types of projects are suitable to be done by consultants rather than employees, and what legal issues should be addressed when using consultants. Ms. Stark states, “A written confidentiality agreement should therefore be put into place to protect the company’s trades secretes from being disclosed by freelancers who are often given broad access to company information in order to complete their work”. She also discusses issues regarding financial and behavioral control when using freelancers and consultants.
