Thomas S. Onder is a Shareholder and Chair of the Shopping Center & Retail Development Group, as well as a member of the Real Estate, Litigation, and Bankruptcy & Creditors’ Rights Groups of Stark & Stark.

Mr. Onder is active in ICSC and concentrates his practice in the area of commercial leasing and litigation, focusing on commercial landlord disputes and secured transactions before state and federal courts in New York and New Jersey. Mr. Onder also represents cooperative, condominium and homeowner associations regarding delinquent owners in bankruptcy filings and rent receiverships.

Mr. Onder is regularly involved in bankruptcy and non-bankruptcy forums representing commercial landlords and developers, financial institutions, equipment lessors and trade creditors in a variety of matters, including the prosecution of commercial eviction and collection actions, pursuing promissory note and guarantee obligations for financial and developmental institutions, replevin actions for commercial equipment lease holders, and creditor representation in Chapter 7 and 11 bankruptcy proceedings, including bankruptcy § 363 sales, reclamation claims and motions for relief.

Mr. Onder and Group team regularly represents several commercial landlords and developers as creditors in Chapter 11 bankruptcy proceedings across the country. Currently, he is litigating in the District of New Jersey in the Rite Aid bankruptcy case and the District of Delaware in the Mountain Sports and Blink Fitness cases. Other recent cases Mr. Onder has protected landlords and owners include the Gander Mountain case in the District of Minnesota, the Hair Cuttery case in the District of Maryland and the Toys “R” Us case in the Eastern District of Virginia and in the Southern District of New York in the A&P and Tops Holdings bankruptcy cases. He has also appeared recently in the District of Western District of New York, and Southern District of Florida for landlords on assumption/rejection of lease issues.

Prior to joining Stark & Stark, Mr. Onder was a law clerk for United States Bankruptcy Judges Kathryn C. Ferguson and Raymond T. Lyons in Trenton, NJ. Prior to his clerkship, Mr. Onder was a legal editor for Collier on Bankruptcy and various commercial legal treatises at LexisNexis. In addition, Mr. Onder interned for United States Bankruptcy Arthur Gonzalez in the Southern District of New York, while in law school.
