In Guadagno the Court unanimously ruled a member of the State Police Retirement System or the Police and Firemen’s Retirements System who suffers from a permanent and total mental disability as a result of a mental stressor, without any physical impact, is entitled to accidental disability retirement provided specific conditions of a stringent legal test are met by the applicant.

Vicki W. Beyer represents Joseph Guadagno, a former New Jersey Corrections Officer who was disabled after an inmate threatened to murder him, his wife and daughter and demonstrated personal knowledge of Mr. Guadagno’s family.  Ms. Beyer argued this matter before the New Jersey Supreme Court in October 2006 and again in November 2007.
