Cary S. Kvitka, is an Associate and member Stark & Stark’s Commercial Litigation Group.  Prior to joining the firm, he served as a Judicial Law Clerk to the Honorable Sheldon R. Franklin in the Superior Court of New Jersey, Chancery Division. Mr. Kvitka’s complex litigation practice builds upon his experience as a transactional attorney, in which he negotiated and/or drafted: commercial leases, franchise agreements and franchise disclosure documents, shareholder agreements, corporate resolutions, manufacturing contracts, software engineering/OEM agreements, employment agreements, and various other technical documents. In that capacity, he also managed or participated in asset and business purchases, commercial real estate transactions, and corporate mergers. 

Mr. Kvitka’s transactional skills enhance his litigation practice, in which he has experience representing companies, condominium/homeowners associations, and private individuals in all aspects of litigation. He has litigated matters involving: environmental claims, commercial contract disputes, franchise issues, corporate governance and shareholder disputes, loan agreements, condominium/homeowner association governance, residential developer transition, and construction defect claims. His recent accomplishments include: participation as a trial team member in the successful resolution of a multi-million dollar construction and environmental claim between two “Fortune 500” companies; the defense of a homeowners association and full dismissal of a private homeowner’s various economic and civil rights lawsuits against that association; participation as a trial team member and the successful resolution of a multi-million dollar condominium transition claim against a residential developer; the successful resolution of a lawsuit on behalf of private homeowners against their condominium association involving maintenance of common elements and breach of fiduciary duty; and the dismissal of criminal charges at trial for the benefit of a pro-bono client.

Mr. Kvitka also serves as a Vice-President, the youngest member of the Executive Committee, and member of the Board of Directors of Jewish Family & Children's Service of Greater Mercer County, which provides comprehensive social services to a diverse community in need.
