  • Condominiums, cooperatives and homeowners associations have multi-faceted legal needs. They need contracts drafted and negotiated, assistance with the enforcement and creation of rules and regulations, alternative dispute resolution, the collection of carrying charges, maintenance fees and assessments, transition from sponsor control, handling and advising as to construction defects, general litigation, municipal relations, fair housing compliance, leasing and landlord/tenant matters.

    Using both a team and cross-disciplinary approach, Stark & Stark’s Condominium and Co-op Group brings together attorneys with expertise in corporate law, bankruptcy, collections, real estate, general litigation and landlord/tenant law. The Group is thus able to counsel, as well as advocate for, its clients. Stark & Stark provides businesses with the ability to have top-notch legal counsel at their disposal on an “as-needed” basis. Our clients contact us to help them plan, deliberate and strategize, and help them to address any legal concerns along the way. We are pro-active, ensuring that our clients are protected from unnecessary risks. We manage our clients’ legal problems so that they can focus on managing, operating and maintaining their associations and/or buildings.

    The Group’s attorneys are active lecturers and authors. They have lectured, given seminars and written articles concerning age-restricted communities, the collection of carrying charges, assessments and maintenance fees, insurance issues, bankruptcy, rules and regulations, alternative dispute resolution, sponsor transition, the Business Judgment Rule, fiduciary duties and affordable housing issues. Stark & Stark’s Condominium and Co-op Group also understands the practical challenges faced by condominiums, cooperatives and homeowners associations every day. They support, help and educate board members, property managers and other professionals, such as engineers, insurance professionals and accountants – privately, in the context of open meetings and with owners and shareholders.

    Stark & Stark represents over 200 condominiums, cooperatives and homeowners associations in New York, New Jersey and Pennsylvania. Our clients receive prompt and personal attention. No building or association is too large or too small. Our clients range in size from 6 to 1400 apartments, units or homes. They range in type from small, single family home communities, to large condominiums and cooperatives, to townhome developments. From our office in Manhattan and our office in Tarrytown, we service our clients in all five (5) of New York City’s Boroughs, as well as Rockland, Orange, Putnam, Dutchess, Westchester, Ulster and Nassau Counties.

    Attorneys in the Group appear regularly before the New York Supreme Court, appellate courts, as well as local courts, commissions and agencies. It has represented clients before those courts, commissions and agencies in matters involving fair housing, unpaid carrying charges, maintenance fees and assessments, rule and covenant enforcement, sponsor issues and construction defects, among other things.
