Frequently Asked Questions
A car hit me. Who pays my medical bills?
It depends on what coverage is in play, and riders are often surprised by the answer. The medical coverage that would pay automatically if you were in a car frequently does not apply when you’re on a bike, because motorcycle policies are written differently and many riders never add the optional medical coverage. That usually leaves some combination of your health insurance, any medical coverage on your motorcycle policy, a claim against the at-fault driver, and your own uninsured or underinsured motorist coverage. Figuring out which one pays first, and getting the rest reimbursed properly, is a big part of what we do.
Are the rules different for riders than for drivers?
Often, yes, and not always in the way people expect. Coverage that comes standard with a car policy may not exist on a bike. Some limits on suing for pain and suffering that apply to drivers do not apply the same way to riders. Which of those matter in your case depends on where the crash happened and what your policies say, so it’s worth a short conversation rather than a guess.
The driver says they never saw me. Doesn’t that get them off the hook?
No. “I never saw the bike” is an admission that they failed to look, not a defense. We hear it in almost every case. What matters is the physical evidence: sight lines, skid marks, vehicle damage, camera footage, and witnesses. That evidence disappears fast, which is the main reason to call early.
Does it hurt my case if I wasn’t wearing a helmet?
Helmet requirements vary, and an insurance company may try to use it to shift blame onto you. It does not automatically end your claim. In most places fault can be shared between people, which can reduce what you recover rather than erase it. Tell us the truth about it and let us handle the argument.
The insurance adjuster already offered me money. Should I take it?
Not before someone independent looks at it. Early offers usually land before anyone knows the full cost of your injuries, and once you sign a release, that claim is closed for good. Have us review it. If the offer is fair, we will tell you so.
How long do I have to do something about it?
Less time than most people assume, and the deadline depends on where the crash happened and who was at fault. Claims involving a government vehicle or a public entity can carry a much shorter notice deadline than an ordinary claim, sometimes a matter of months. If you think you might be close to a deadline, call today rather than next week.
My crash was a few years ago. Is it too late?
Maybe not. Deadlines can run differently if the injured rider was a minor, if the injury took time to surface, or depending on who was at fault. It costs you nothing to find out, and the answer usually takes one phone call.
What does it cost to hire you?
Nothing up front. We take injury cases on a contingency fee, which means our fee comes out of the recovery and you owe no attorney’s fee if we do not recover for you. The consultation is free either way.
I’m not sure you cover where my crash happened.
Reach out anyway. We have relationships with attorneys around the country, and if your case belongs with someone else, we’ll tell you rather than leave you guessing.
My question isn’t about a crash at all.
