Trick-or-Treat Safely: Tips from a Personal Injury Attorney

    October 22, 2025

Halloween is one of the most exciting nights of the year for kids — costumes, candy, and community fun. But with the excitement also comes an increased risk of accidents and injuries. As a personal injury attorney, I’ve seen how quickly a fun night can turn dangerous when safety is overlooked.

Here are some important tips to help keep you and your family safe while trick-or-treating this Halloween.

    Pedestrian Safety: Watch for Cars

    • Use sidewalks whenever possible: If no sidewalks are available, walk facing traffic and stay as far off the roadway as you can.
    • Cross streets at corners and crosswalks: Teach children to look left, right, and left again before crossing.
    • Stay visible: Carry flashlights, wear glow sticks, or add reflective tape to costumes and candy bags.
    • Drivers may not see you: Excited kids in dark costumes are hard to spot—especially at dusk. Always assume drivers can’t see you.

Costume Safety: Make it Fun and Functional

    • Avoid masks that block vision. Use face paint or makeup instead so kids can see clearly.
    • Choose non-flammable materials. Costumes should be flame-resistant and fit properly to prevent trips and falls.
    • Be weather-ready. Layer under costumes and wear comfortable shoes, even if they don’t “match” the outfit.

    Property Safety for Homeowners

If you’re welcoming trick-or-treaters, remember that you have a duty to keep your property safe:

    • Keep walkways clear: Remove leaves, decorations, and cords that could cause a fall.
    • Light the way: Make sure driveways and steps are well-lit.
    • Secure pets: Even friendly pets can get nervous with costumed visitors.

A slip, trip, or dog bite on your property can turn into a legal issue — prevention is the best protection.

    Driver Safety: Slow Down

Halloween night has one of the highest rates of pedestrian injuries involving children all year.

    • Drive slowly and stay alert in neighborhoods. Expect kids to run into the street.
    • Avoid distractions. Put the phone down and keep your eyes on the road.
    • Be extra careful at driveways and intersections.

Final Thoughts: Speak with an Experienced Personal Injury Attorney if You or Someone You Know is Injured Fur to Another Person’s Negligence

Halloween should be about fun, not fear. A few precautions can make the night safer for everyone. If you or someone you know is injured due to another’s negligence — whether from a car accident, unsafe property, or other hazard — know your rights and speak with an experienced personal injury attorney.

Stay safe, have fun, and Happy Halloween!
