Stark & Stark is proud to announce that Associate Joseph Gable has secured a $350,000 verdict for his client who was in a serious car accident. In May of 2016, 27-year-old Ms. Silva was driving home from work in Clementon, New Jersey when the Defendant, who was at a stop sign, pulled out into the road without seeing Ms. Silva and caused a collision. Later that night, and into the morning, Ms. Silva started feeling some pain in her neck and her back. After seeing a chiropractor and consulting with multiple doctors, she was evaluated by a spine specialist, Dr. Joseph Zerbo, who advised her not to move forward with any kind of surgery due to her age.
Stark & Stark tried the case against the Defendant, and Ms. Silva explained the long-lasting effects of her injuries and how they have affected and changed her personal relationships, including those with her husband and stepson. Joseph Gable was happy to help Ms. Silva navigate through her new reality of not being able play with her kids or get a full night’s sleep.
The trial was held in Camden County, New Jersey. Instead of having doctors testify in court, the jurors were given all of Ms. Silva’s medical reports, and the defense hired a doctor to examine Ms. Silva. The defense’s doctor indicated that he didn’t believe there was anything wrong with her. Ultimately, the jury found that the Defendant was negligent, and that negligence caused the crash that left Ms. Silva permanently injured. They awarded Ms. Silva $350,000 in damages for her injuries, which included two bulging discs in her cervical spine and three bulging discs in her lumbar spine.
“Our job is to make sure the jury has the tools and information to make that final decision for our clients,” Mr. Gable explained. “Through Ms. Silva’s testimony, the jury was able to understand the damages and the affects her injuries have had on her life. Although this award cannot cure her injuries, I am hopeful that it provides her with some resources that will help her as she tries to return to a normal life.”
