Andrew J. Podolski is a Shareholder and member of Stark & Stark’s Construction Law Group, where he concentrates his practice on representing multi-family residential and commercial property owners in construction related conflicts. His practice encompasses disputes between homeowner/condominium associations and developers over transition of control, construction defect claims, litigation with contractor-vendors and insurance coverage claims on behalf of policyholders.

Mr. Podolski also has experience representing property owners, builders, contractors, franchisors and other businesses in a wide variety of matters such as contract disputes, construction lien availability and enforceability, delay damages, consumer fraud claims and litigation exposure/avoidance counseling. Beyond the construction industry, Mr. Podolski has experience representing clients in general business disputes/litigation and attorney malpractice claims.

  • Currently lead trial counsel in matters with amounts in controversy ranging from in excess of $25,000,000 down to $1,000,000.
  • In 2018, served as lead trial counsel to recover settlements in excess of $7.000.000* in complex construction and design defect matter involving a large, 5 building condominium community in Middlesex County.
  • In 2017, served as lead trial counsel to recover settlements in excess of $6,000,000* in a complex construction defect matter involving a large, 8 building condominium community in Passaic County.
  • In 2016, served as lead trial counsel to recover settlements in excess of $5,750,000* in a complex construction defect involving a large condominium development in Old Bridge, New Jersey.
  • In 2014, served as lead trial counsel to obtain a $2,300,000* verdict following a 3 week trial in Hudson County for an 8-story residential condominium building suffering extensive construction and design deficiencies.
  • In 2013, served as lead trial counsel to recover in excess of $4,000,000* in combined settlements and a trial judgment in a complex construction defect case in Union City, NJ.
