  • The United States Environmental Protection Agency (“EPA”) has taken the rare step of exercising its emergency powers under the Federal Insecticide, Fungicide and Rodenticide Act (“FIFRA”) to immediately suspend the use of the dangerous pesticide dimethyl tetrachloroterephthalate (“Dacthal” or “DCPA”).

    What is Dacthal DCPA?

    Dacthal DCPA is manufactured by AMVAC Chemical Corporation and used to control weeds in both agricultural and non-agricultural settings. While used on turf in recreational areas, ball fields, and parks, Dacthal DCPA is primarily used on crops such as broccoli, Brussels sprouts, cabbage, and onions.

    The EPA has determined there are no practical mitigation measures, including personal protective equipment and engineering controls, that can be put in place to allow continued use of Dacthal DCPA. Due to the serious and imminent harm posed by Dacthal DCPA, an emergency exists such that the EPA’s order of suspension effective immediately is necessary. Therefore, Dacthal DCPA is so dangerous that it must be immediately pulled from the market.

    Do I Have a Dacthal Lawsuit Claim?

    The following individuals may qualify for a Dacthal DCPA Lawsuit Claim:

    • Pregnant women serving as agricultural workers on farms where Dacthal DCPA was used;
    • Pregnant women living near farms or other treated areas and were exposed to Dacthal DCPA through air, soil, or water pathways;
    • Pregnant women exposed to turf treated with Dacthal DCPA in recreational areas, ball fields, and parks.

    The EPA has determined that the babies of pregnant women exposed to Dacthal DCPA are subject to altered thyroid hormone levels, which can lead to irreversible:

    • low birth weight;
    • impaired brain development;
    • decreased IQ; and
    • impaired motor skills later in life.
