Timothy P. Duggan, Esq. obtained a $441,948 award after a two-day hearing before the Board of Condemnation Commissioners in Morris County, New Jersey. The New Jersey Department of Transportation initially valued a partial taking of land at $71,000.
The case had to wind its way through an administrative hearing to determine whether the change in highway access for a restaurant was reasonable. Once the access issues were decided, the damage case for the loss of several parking spaces was litigated in a contested hearing.
The parties had to brief and argue many complex evidentiary issues, including the admissibility of evidence on the cost to cure damage. Stark & Stark was proud to represent the property owners who had the necessary grit to fight back to protect their business and wishes to extend it thanks to the expert witnesses who were outstanding.
