Timothy P. Duggan, Esq. obtained a $441,948 award after a two-day hearing before the Board of Condemnation Commissioners in Morris County, New Jersey. The New Jersey Department of Transportation initially valued a partial taking of land at $71,000.
The case had to wind its way through an administrative hearing to determine whether the change in highway access for a restaurant was reasonable. Once the access issues were decided, the damage case for the loss of several parking spaces was litigated in a contested hearing.
The parties had to brief and argue many complex evidentiary issues, including the admissibility of evidence on the cost to cure damage.
