Stark & Stark environmental lawyers represent a wide range of clients in the purchase and sale of renewable energy, renewable energy credits or certificates, verified emissions reduction certificates, emissions allowances, and other environmental trading products.
We prepare and negotiate numerous wholesale and retail electric power purchase agreements, as well as energy derivatives, electric transmission, interconnection, operation and maintenance, advanced billing, licensing, and other agreements. These contracts involve a wide range of transactions, including long-term and short-term energy and capacity purchases and sales.
At Stark & Stark, our attorneys combine the experience of our Real Estate, Zoning, & Land Use and Green Building Groups when negotiating the terms of power purchase agreements (PPA) for clients in the renewable energy industry. We utilize the knowledge and depth of resources our attorneys have gained over the past 90 years in order to provide clients with the most timely and cost-effective solution to their needs. We advise clients in all aspects of the financing, development, and construction of solar and other renewable energy projects.
Our business attorneys understand that a PPA is a critical component of any renewable energy project. We have a thorough appreciation of the risks associated with renewable energy projects and, therefore, we carefully negotiate and draft each PPA to avoid potential liabilities and disputes between developers and purchasers.
Additionally, we understand that financing for renewable energy projects can be an important part of making a PPA work, and, as a result, we utilize the experience of our Banking & Financial Services Team when drafting PPAs for clients.
Recently, our attorneys assisted in obtaining approvals for the installation of the Western Hemisphere’s largest private solar power generation plant. The $60,000,000, 50-acre solar farm will produce 18 million kilowatts of power annually; enough to power the equivalent of 1,500 homes. Moreover, the project reduces greenhouse gases by over 12 metric tons, the equivalent of taking almost 2,500 cars off the road.
