Equitable Distribution

There are many factors the Court considers in deciding the division of marital assets in Pennsylvania, including:

  • Age of the parties
  • Health of the parties
  • Length of marriage
  • Difference in income
  • Whether one party was a stay-at-home parent
  • Whether one party has a large amount of non-marital assets

Marital Assets

Any asset acquired from the date of marriage through the date of separation is a marital asset, regardless of how it is titled or who paid for it. The increase in value of an asset brought into the marriage by either party is also a marital asset.
These assets include:

  • real estate;
  • automobiles;
  • household items;
  • boats;
  • IRAs;
  • 401(k) accounts;
  • retirement assets;
  • pension plans;
  • investments;
  • stock options;
  • business interests; and
  • other assets.


Debt acquired from the date of marriage through the date of separation is divided when a Husband and Wife divorce. The Court considers many factors in determining how much debt will be attributed to each spouse.
