What is Metformin?

Metformin is the most popular type 2 diabetes oral medication in the world. Also used to treat polycystic ovary syndrome, metformin is a first line treatment for type 2 diabetes. In diabetics, metformin basically works by decreasing glucose production in the liver. Metformin is regularly used by type 2 diabetes patients from diagnosis throughout their entire lifetime.

Metformin was introduced in Europe several decades ago and has been sold under various trade names, including Glucophage and Fortamet. Currently, generic versions of metformin are widely manufactured and distributed in the United States by overseas pharmaceutical companies.

In early 2020, an independent laboratory informed the Federal Drug Administration (FDA) that testing showed certain forms of metformin, particularly extended release metformin, made by generic manufacturers contain dangerous impurities such as N-Nitrosodimethylamine (NDMA), and N-Dimethylformamide (DMF). It is believed that these impurities may have the potential to cause cancer and/or serious liver damage, prompting ongoing widespread recalls published by the FDA.

This story may sound familiar, as recent testing has shown dangerous levels of similar compounds in Valsartan and Zantac. Recalls of those tainted drugs have spawned nationwide lawsuits on behalf of those injured by the probable human carcinogens found by independent testing and the FDA.

Do I Have a Metformin Claim?

Not all metformin is tainted or contaminated, but the FDA list of recalls is growing. If you or a loved one was taking extended release (ER) metformin from the list of potentially tainted lots and have suffered one or more of the following injuries or side-effects, you may be entitled to compensation.

FDA recommends that health care professionals continue to prescribe metformin when clinically appropriate. The agency’s testing has not shown NDMA in immediate release (IR) metformin products (the most commonly prescribed type of metformin).

The entities specifically identified by the FDA as involved in the recalls currently include Amneal, Apotex, Avkare, Bayshore Pharmaceuticals, Granules Pharmaceuticals, Lupin Pharmaceuticals, Marksans, PD-Rx Pharmaceuticals, Preferred Pharmaceuticals, Sun Pharmaceutical Industries, Teva (Actavis), and the Harvard Drug Group.

Such claims may eventually include lawsuits brought by individuals and/or classes of plaintiffs based upon: economic damages from purchasing the recalled drugs; personal injury damages from cancer or severe liver damage caused by the recalled contaminated drugs; and economic damages from insurers and other third-parties that paid for the recalled drugs. These nationwide claims could be consolidated into a Multidistrict Litigation (MDL).
