Stark & Stark Scores Recent Settlement Victories for Condo Communities Totaling Nearly $10 Million

Stark & Stark’s nationally recognized Construction Litigation group has scored some recent victories, advocating for community association and condo community clients while negotiating two major settlements in complex construction defect litigation claims for nearly $10 Million.

Most recently, the group skillfully negotiated a settlement on behalf of a Condominium Association in excess of $5.75 Million for a complex construction defect case against more than 45 defendants involving damages from water infiltration to 188 condominium units spread over 26 buildings. Stark & Stark Shareholder Andrew Podolski took the case from inception, developed and implemented the strategy, and otherwise put the case together for a jury trial. Trial was scheduled to begin on May 23, and was expected to run more than 2 months. The ramp up of trial prep activity and the looming trial date ultimately brought the defendants to the table for rigorous settlement negotiations.

The second recent victory came on behalf of client Thread Condominium Community, for whom Stark & Stark settled a complex construction and design defect case for $4 Million, which involved claims of damages caused by water infiltration in a 15 story high rise building with 151 units in Union City, NJ. Stark & Stark took over the case on a contingency when the condominium association terminated its prior counsel. Under intense time pressure from the Court, our team reviewed well over 100,000 pages of discovery documents, lined up and took all of the fact and expert depositions, analyzed all of the insurance policies, conducted mediation of the matter, and partially settled the case just before Christmas last year. Recently, the final two claims were settled just as the case was headed to trial at the end of March.
