Gene Markin is an Associate in Stark & Stark’s Construction Litigation Group where he concentrates his practice on complex construction litigation involving community associations, developers, sponsors, design professionals, engineers, and contractors.  He has represented numerous condominium associations in construction defect cases involving faulty workmanship and negligent installation of exterior claddings, EIFS (exterior insulation finish system), stucco, brick, stone, masonry, cultured masonry, balconies and decks, windows and doors, Duradek, Azek Trim, EPDM roofs, shingled roofs, torch down bitumen roofs, waterproofing, flashings, sealants, joints, framing, fireproofing, and foundation work.

Successfully prosecuting and defending claims arising out of negligent construction, breaches of fiduciary duty by sponsor-appointed board members, violations of the New Jersey Condominium Act and the Planned Real Estate Development Full Disclosure Act as well as breaches of express and implied warranties, Gene has extensive experience dealing with the multitude of complex insurance issues that arise in litigation including policy interpretation and analysis, Commercial General Liability coverage, and applicability of policy exclusions.

While attending law school, Gene was a member of the Drexel Law Review as well as the Drexel Law National Trial Team and competed in several competitions across the country.  He was also honored with the Philadelphia Trial Lawyers Association James J. Manderino Award For Trial Advocacy.

Notable Matters

  • Collected over $15 million in settlements for a premier condominium development in Jersey City that was plagued with pervasive water damage as a result of negligently designed and installed EIFS, masonry, panel cladding, roofs, balconies, railings, windows and doors, and structural foundation supports.
  • Recovered $4 million, including settlements and judgment at trial, for a Union City based condominium client that involved pervasive water infiltration in a high-rise building clad with brick, EIFS, and a window wall system.  
  • Obtained a $2.5 million verdict against a negligent builder who used substandard materials, inadequate flashing, and shoddy workmanship to build a six-story residential condominium building in Hudson County that suffered from pervasive water leaks, mold growth, and steel deterioration. 
  • Won an appeal that overturned and reversed the trial court’s dismissal of an almost $30 million dollar construction defect case based on an association’s decision to file suit without first complying with a pre-litigation voting requirement in its by-laws, but that the Appellate Division said was able to be ratified by the membership after the complaint had already been filed.
