Bisphosphonate Mass Tort

Bisphosphonates are commonly sold under various brand names including Fosamax®, Actonel®, Aredia®, and Zometa®, and are manufactured by such large drug companies as Merck, Novartis, Procter & Gamble, and Sanofi-Aventis. Bisphosphonates are generally marketed as drugs that promote the regeneration of bone by preventing bone degradation from natural body absorption. These drugs have been widely used since the mid-1990’s to treat osteoarthritis, Paget's disease and the osteoporosis specifically experienced by patients taking corticosteroids. Bisphosphonates are commonly used during cancer treatments to strengthen bones and keep cancer from metastasizing in the bones. Bisphosphonates are also widely prescribed for the long-term treatment of post-menopausal women in order to prevent and treat osteoporosis.

Two major side-effects of bisphosphonates have been reported to be: 1) Osteonecrosis of the Jaw (and more rarely seen osteonecrosis in other parts of the body); and 2) low-energy, femur fractures (and more rarely seen low-energy fractures in other parts of the body). Osteonecrosis of the Jaw (ONJ) is a disease where the jawbone does not heal from injury. This disease has also been known as Dead Jaw, Fossy Jaw or Phossy Jaw. Usually, the disease is prefaced by a simple dental procedure or other trauma to the jawbone. Thereafter, the jaw quickly becomes infected and all or a portion of the jawbone can actually die and/or fracture and be painfully thrust through the skin and gums. Studies show that the low-energy, femur fractures generally occur from stress or a fall from standing height or less, where the bone breaks in an unusual, horizontal pattern. Such bone necrosis or bone brittleness has also been reported to have been found, though much more rarely, in other parts of the body.
