Toxic Torts
Demonstrating that a person has been harmed due to a toxic tort is a difficult process. A class action lawsuit is one that involves a grouping of plaintiffs with similar legal claims, usually involving a commercial or business related matter. These class action claims, or toxic torts, include the exposure of individuals to dangerous chemicals or biological substances. When the exposure is due to neglect or lack of concern on the part of an employer, the injured party is entitled to compensation for damages incurred.
Children and industrial workers are at greatest risk of being exposed to toxic substances, although, exposure can occur to just about anyone while at work, or even as the result of an environmental contamination throughout an entire community. Injuries will most often occur as a result of exposure over a long period of time and are usually permanent and irreversible, however, in some cases the exposure may be only temporary.
Lead-based paint leading to severe brain injuries is an example of serious harm that can result due to toxic substance exposure. Other examples of toxic substances people frequently come in contact with include: contaminated air or water usually from waste disposal sites (i.e. asbestos and dry cleaning/other solvents), heavy metals (i.e. mercury and arsenic), pesticides (i.e. DDT and doxin), exposure to electromagnetic fields (i.e. electrical towers and utility wires), and pharmaceutical drugs.
