Redevelopment in New Jersey
Redevelopment is a function of community planning often used to reinvigorate so-called blighted residential and commercial areas. Given the currently broad definition of the term "blight" which currently includes "smart growth" opportunities, existing and potential redevelopment impacts virtually every municipality in New Jersey. Redeveloment has become a critical if not overriding component of residential development opportunities in New Jersey. Communities and their residents often benefit from redevelopment through improved services, investments and tax revenue. Much like more traditional development schemes, the tremendous opportunity for homebuilders existing in redevelopment can also be fraught with risk if planning and legal issues are not adequately addressed in accordance with the rapidly changing body of law. Despite the positive byproducts of redevelopment, recent court decisions, organized opposition and negative attention have brought attention to and highlighted perceived or, in some cases, real abuses of the process and in turn brought increased public and political scrutiny of the redevelopment process. Indeed, proposed, competing and vigourously debated legislation is likely to be adopted in the near future and will once again change the redevelopment landscape. Staying ahead of these issues is critical to the success of hopeful and existing redevelopers.
On Tuesday November 7, 2006, attorneys from Stark & Stark, conducted an hour-long web seminar for members of the New Jersey Builders Association (NJBA) which discussed how businesses can benefit from engaging in the redevelopment process. The seminar provided participants with the following important information:
Legislative Update on Redevelopment - Gary Forshner discussed proposed and pending legislation that will greatly change how developers and municipalities plan for and use redevelopment and eminent domain. Gary serves in various capacities on behalf of NJBA, including as an Alternate Trustee of BPAC and on the Land Use and Planning Committee.
Structuring of Redevelopment Plans and Working With Municipalities - Vincent Mangini discussed the necessary planning and procedures every required redevelopment plan must have in order to minimize potential challenges. He also discussed the contractual agreements between redevelopers and municipalities necessary to allow participation in the redevelopment process.
Defeating Challenges to Your Plan - Timothy Duggan discussed how redevelopers can best protect their business interests during the condemnation phase of the redevelopment process by explaining defenses used to defeat or delay redevelopment project.
